Terms of Service
Last updated
These terms govern your use of Mentionwell ("the Service"). By signing in, you accept them. If you don't, don't use the Service.
1. Acceptance
These Terms of Service ("Terms") form a binding contract between you (or the entity you represent) and ZipLyne ("we," "us"), publishing as Mentionwell. By creating an account, signing in, or using the Service, you agree to these Terms and our Privacy Policy, Cookie Policy, and Acceptable Use Policy.
If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
The Service is a headless AEO / GEO / LLMO blog engine. Once you onboard a domain, the Service generates articles end-to-end (research, outline, draft, editorial critic, metadata, FAQ, embedding, image generation) and serves them via a public read-only API or pushes them into a CMS you connect.
The Service is in public preview. Features, pricing, and availability may change. We will give reasonable notice of breaking changes.
3. Your account
- You must keep your credentials confidential and are responsible for activity under your account.
- You must provide accurate information and keep it current.
- You must be at least 16 years old (or the digital-consent age in your jurisdiction).
- One person, one account, unless we authorize otherwise in writing.
4. Permitted use
You agree to use the Service only in compliance with these Terms, our Acceptable Use Policy, and applicable law. You may not, and may not allow anyone else to:
- Reverse-engineer, decompile, or attempt to extract the source of the Service.
- Resell, sublicense, or commercialize the Service except through features we expose for that purpose.
- Use the Service to generate unlawful, infringing, harmful, deceptive, or harassing content.
- Attempt to overwhelm, probe, or evade rate limits.
- Use the Service to train a competing AI model.
5. Your content
You retain ownership of content you provide and content the Service generates for you ("Customer Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, display, and process Customer Content solely to operate, secure, and improve the Service for you. You represent that you have the rights necessary to grant this licence and that Customer Content does not violate any law or third-party right.
6. AI-generated output
The Service uses third-party large language models (currently Anthropic Claude and OpenAI GPT) to draft Customer Content. You agree that:
- Output is generated probabilistically and may contain errors, omissions, or hallucinations. You are responsible for reviewing every article before it is published to your audience.
- Two users prompting similar topics may receive similar output. We make no exclusivity claim over generated phrasings or structure.
- Output may be subject to the policies of the underlying model providers; you agree to comply with their acceptable-use policies as listed on the Subprocessors page.
- Where required by law, you must disclose that content was generated with AI assistance.
7. Intellectual property
The Service, including its software, design, brand assets, and documentation, is and remains our property and our licensors'. These Terms do not grant you any right in our trademarks, logos, or domain names except as needed to use the Service as intended.
8. Fees and billing
The Service is currently in public preview and may be free of charge. When we introduce paid plans, fees will be billed in advance and are non-refundable except as required by law or as set out in our Refund Policy. Taxes are your responsibility unless we are required to collect them. We may change pricing on notice; price changes affect future renewals only.
9. Termination
You may stop using the Service at any time and request account deletion at support@mentionwell.com.
We may suspend or terminate your account if you breach these Terms or the AUP, or if continuing to provide the Service exposes us to material legal or security risk. We will give reasonable notice except where the breach is material or urgent.
Sections of these Terms that by their nature should survive termination — including content licences, fees owed, IP, warranty disclaimers, liability limits, and governing law — survive termination.
10. Warranties
The Service is provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or trade usage. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated output will be accurate, original, or fit for any purpose.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, goodwill, or other intangibles, even if advised of the possibility. Our total cumulative liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the fees you paid us in the 12 months before the event giving rise to liability, or (b) USD 100.
12. Indemnification
You will defend, indemnify, and hold us and our affiliates harmless from any claim, demand, or proceeding (and reasonable attorneys' fees) brought by a third party arising from or relating to your Customer Content, your use of the Service in violation of these Terms or the AUP, or your violation of law or any third-party right.
13. Governing law
These Terms are governed by the laws of the United States, excluding conflict-of-laws rules. The exclusive forum for any dispute is the federal or state courts in that jurisdiction, and each party consents to personal jurisdiction there. Nothing in this section limits any non-waivable consumer rights you may have under your local law.
14. Changes
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version. For material changes, we will give at least 30 days' notice by email or in-product. Continued use of the Service after the effective date means you accept the updated Terms.
